2. Personal data we may collect from you
2.1. We may collect and process the following information about you (“Data”):
(a) Basic personal details including [name, telephone number, email address and postal address]
(b) Site usage and other technical data such as information about the browser or device you use to access this Site and the Unikeys Wallet mobile application, your internet protocol address, how you use this Site, the Unikeys Wallet mobile application and the pages you visit, traffic and location data;
(c) When you submit a job application to us via any means, recruitment related data such as your curriculum vitae, your education and employment history, details of professional memberships and other information relevant to evaluating your job application; and
(d) Any other personal data relating that you may provide to us from time to time.
2.2. We may notify you from time to time if it is mandatory for you to provide us with any Data requested. In the event that you do not provide any Data that we have indicated as mandatory, we may not be able to provide you with our products or services or to comply with your requests.
2.3. Please note that any biometric data collected by any of our products that have been purchased by you, shall be securely stored on such products, and we will not have access to and shall not collect any of your biometric data.
3. How we collect your data
3.1. We generally use the following methods to collect Data:
(a) Direct interactions with us, or any of our service providers or Unikeys Group Companies on our behalf, including (without limitation) when you complete any of our online forms, or register or subscribe to receive any of our services, alerts, updates or direct marketing materials, or seek to place any orders or to purchase any products from us, or correspond with us by email, phone, post or otherwise; and
(b) Automated technologies or interactions, where we will automatically collect technical data about your equipment, browsing activities and patterns as you interact with our Site and Unikeys Wallet mobile application.
4. How we use your data
4.1. We will only use the Data where we have your consent, or where we are permitted to do so under applicable law. Unless otherwise stated, we will use the Data provided to or obtained by us in order to:
(a) Operate and maintain the Site, the Unikeys Wallet mobile application, and provide you with functions or service in relation to the Site and Unikeys Wallet mobile application;
(b) Respond to your queries and feedback in relation to Unikeys, the Site, the Unikeys Wallet mobile application, and or any products or services provided by us or any Unikeys Group Company;
(c) Subject to your prior consent, provide you with promotional or marketing information in accordance with Section 5 below, unless you notify us otherwise in writing that you do not want to receive such materials;
(d) Process your application to register for a user account with us, and managing, administering and maintaining such user account;
(e) Perform our obligations under any contracts entered into between you and us, including (without limitation) processing, administering and fulfilling any orders placed by you;
(f) Process payments for, and deliver any products or provide any services ordered or requested by you, and provide you with any ancillary services;
(g) Provide you with a more customised and personalised experience when you access and use our Site or Unikeys Wallet mobile application;
(h) Create, administer and maintain your profile, including (without limitation), any orders or products purchased by you
(i) Provide you with alerts or updates where you have consented to receive these by registering for them on the Site and Unikeys Wallet mobile application;
(j) Process applications for employment submitted via the careers section of our Site or any other means, and to assess your suitability for any position for which you may apply through Unikeys Group Companies, including background and reference checks, and obtaining references;
(k) Allow you to participate in any interactive features of the Site and Unikeys Wallet mobile application;
(l) Notify you about changes to the Site and Unileys Wallet mobile application;
(m) Ensure Site and Unikeys Wallet mobile application content is presented in the most effective manner for the device you are accessing it from;
(n) Undertake research and data analytics in order to improve our Site, Unikeys Wallet mobile application, business operations, marketing plans, products/services, customer relationships and experiences; and
(o) Detect and prevent misuse or abuse of this Site, the Unikeys Wallet mobile application or our services;
(p) Enforce our rights or the rights of any Unikeys Group Company against you in any legal proceedings, or to defend ourselves or any Unikeys Group Company in any claim brought by you or which relates to you; or
(q) Comply with any applicable law or regulations, or any requirements, codes, guidelines, orders or requests issued by any law enforcement agency, government or regulatory authority or court or arbitral tribunal of competent jurisdiction.
4.2. Without prejudice to the generality of Section 4.1(q), we also use the Data to meet our compliance obligations, to comply with other laws and regulations and to share with regulators and other authorities that Unikeys Group Companies are subject. This may include using it to help detect or prevent crime (including terrorism financing, money laundering and other financial crimes). We will only do this on the basis that it’s needed to comply with a legal obligation, it is in our legitimate interests and that of others or to prevent or detect unlawful acts.
5. Marketing activities
5.1. We cannot use or transfer your Data to any third party for direct marketing purposes without your prior consent.
5.2. Subject to your prior consent, we may use and share amongst the Unikeys Group Companies your Data in order to provide targeted advertising and/or to send any offers, promotions, information on competitions or events, news, alerts, updates or other marketing or promotional materials relating to hardware and/or software products or services for cryptocurrency storage provided or offered by us or any Unikeys Group Company (“Marketing Materials”).
5.3. You have the right to choose not to receive any Marketing Materials from us, or to choose not to have your Data shared with any Unikeys Group Company for them to send you their own Marketing Materials, by not checking the appropriate box on the forms that we use to collect your Data in order to indicate that you do not consent to such marketing activities. You can unsubscribe or withdraw your consent in relation to receiving Marketing Materials, at any time, by sending your request via email to the contact details provided in Section 15 below or through any other unsubscribe mechanism provided by Unikeys or the relevant Unikeys Group Company, from time to time.
6. Who we share your data with
6.1. We may share and transfer your Data to the following third parties (whether they are located inside or outside the country in which you provided it to us), in order to fulfil any of the purposes stated in Section 4 above, any PICS that we have provided to you on or before the collection of your Data, or where you have otherwise provided us with your consent:
(a) Unikeys Group Companies;
(b) any of our service providers or the service providers of any Unikeys Group Company;
(c) any third parties whose products and services you have inquired about;
(d) any law enforcement agency, legal or regulatory authority or court or arbitral tribunal of competent jurisdiction.
7. How long we keep your data
7.1. We will retain your Data for as long as is necessary to fulfil the purpose for which this Data was collected and any other directly related purpose, or as otherwise required or permitted under applicable law. For example we may retain information to comply with legal or regulatory requirements or for our legitimate purposes, such as responding to queries or complaints, fighting fraud and financial crime, responding to requests from regulators, etc.
8. Countries to where we transfer your data
8.1. The Data may be transferred to and stored in locations outside the jurisdiction in which you provide it or where you are viewing our Site and the Unikeys Wallet mobile application. If you are based in the European Economic Area (“EEA”), this will mean that your Data may be transferred to, accessible from, and/or stored at, a destination outside the EEA in which data protection laws may not be as comprehensive as the EEA. When we do this, we will ensure that our recipients of the Data have in place an adequate level of protection so that the transfer is lawful.
